Southern Belle knows that a vacation rental is all about having a good time and spending quality time with family and friends. Below you will find our policies and the Southern Belle way of taking care of your home. We know that most of this agreement may not pertain to you and in no way are we suggesting that you will do anything other than leave your foot prints behind, but in order to provide each guest with a great experience and exceptional service, we must ask that you please follow our rules. Please take a few moments to read over this policy.
House Rules & Guest Responsibilities
Age Requirement
● Guests must be 25 years of age or older to book and occupy the Property.
● Reservations made by individuals under 25 are subject to immediate cancellation without refund.
Guest Responsibility
● Guests are responsible for all actions and conduct of their entire group, including invitees.
● Guest agrees to inform all occupants of the Property rules and regulations.
Occupancy Limits
● Exceeding maximum occupancy will result in immediate eviction without refund.
● This requirement is mandated by insurance regulations, fire codes, and city ordinances.
● Southern Belle reserves the right to inspect the Property during Guest’s stay to ensure compliance.
Events & Gatherings
● No parties, gatherings, or events of any kind are permitted.
● An “event” is defined as any gathering where the number of attendees exceeds the maximum sleeping occupancy listed in the Confirmation Letter.
● Loud music, disruptive behavior, or disturbances to neighbors will result in immediate eviction without refund.
● Additional cleaning or damages fees may be assessed for unauthorized events.
Prohibited Items
● Guest shall not bring hazardous materials onto the property, including but not limited to fireworks, explosives, flammable items, firearms, gasoline, or other dangerous substances.
Southern Belle Vacation Rentals Operating Hours and After Hours Emergencies
We are open seven days a week: Monday through Friday from 9:00 a.m. to 7:00 p.m., and Saturday and Sunday from 10:00 a.m. to 7:00 p.m.
If you need assistance—whether for an emergency or a non-emergency—please contact us during our regular business hours. Non-emergency issues include, but are not limited to, internet outages, malfunctioning TVs or remote controls, DVD player issues, or appliances such as washing machines, dishwashers, or light bulbs that are not working.
For emergencies outside of business hours, please call 912-289-0130. Our outgoing voicemail will provide the appropriate emergency contact number. Emergency situations include, but are not limited to, loss of heat or air conditioning, no hot water or electricity, fires, flooding, or similar urgent issues.
Damage to Homes and Lost or Damaged Items
● Each property is thoroughly inspected before and after every reservation. If any damage, excessive wear, or missing items are discovered during the post-stay inspection, the cost of repair or replacement will be charged to the account on file.
● Do not attempt to fix any items you have broken. Please call to report the damage so that we may fix it to avoid a negative experience for future guests or the homeowner. If you notice any property damage upon your arrival, please bring it to our attention immediately by calling or texting 912-289-0130.
Furnishings
● The property is furnished and decorated according to the homeowner’s taste.
● Guest has reviewed the Property photos on www.southernbellevacationrentals.com and accepts the furnishings as presented.
● Guest agrees to exercise care with furnishings. Any furniture rearranged must be returned to its original placement prior to departure.
Assumption of Risk, Liability Waiver & Hold Harmless
Responsible Guest & Party
The “Responsible Guest” is the individual who signs this Agreement and completes the reservation. The Responsible Guest affirms that:
● They are at least 25 years of age.
● They are authorized to bind all members of their party, including guests and invitees (“Occupants”), to this Agreement.
● No person may occupy or visit the Property or any Southern Belle-affiliated amenity unless subject to the terms of this Agreement.
● The Responsible Guest accepts all liability for the conduct, actions, and safety of all Occupants and visitors.
Use at Own Risk
Guest acknowledges that use of the Property, including but not limited to stairs, decks, pools, spas, hot tubs, appliances, furnishings, recreational equipment, or other on-site or off-site amenities, involves inherent risks of injury, illness, or property damage. All use is strictly at the Guest’s own risk, and Guest voluntarily assumes full responsibility for themselves, their party, and their invitees.
Pools, Amenities, and Off-Site Facilities
Southern Belle Vacation Rentals, LLC (“Southern Belle”) invests significant resources to provide guests with exceptional, world-class amenities and experiences unmatched by any other vacation rental company. These offerings include, but are not limited to, use of the Southern Belle Pool located at 19 Silver Avenue, also known as 20 Silver Avenue, Tybee Island, Georgia, as well as any pool, fitness area, recreational space, or entertainment venue owned, managed, or made available by Southern Belle. Use of any such pool or amenity is entirely voluntary and undertaken at the Guest’s own risk. No lifeguard is on duty.
Guests and all Occupants hereby release and hold harmless Southern Belle, its owners, members, employees, contractors, affiliates, successors, and assigns from any and all claims, causes of action, or liabilities arising from or related to use of any Southern Belle property, facility, or amenity—whether on or off the premises of the rental home—regardless of cause, including the alleged negligence of Southern Belle or its affiliates.
Coastal Foundation, Chippewa Social Club & Affiliated Events
From time to time, Southern Belle may invite or allow Guests to attend events, programs, or activities organized by or affiliated with Coastal Foundation, Inc., Chippewa Social Club, LLC, or Tybee Country Club (collectively, the “Affiliated Entities”). These may include fundraisers, live music events, dinners, community gatherings, pool parties, entertainment, and other guest-oriented activities.
Participation in any such event or use of any affiliated facility is wholly voluntary and at the sole risk of the Guest. By signing this Agreement, the Responsible Guest—on behalf of themselves and all Occupants—expressly agrees to hold harmless and indemnify Southern Belle, the Affiliated Entities, and their respective owners, directors, officers, members, employees, contractors, volunteers, successors, and assigns from any claim, injury, illness, or loss arising out of or relating to participation in any such activity or event, regardless of fault or cause, including negligence or premises conditions.
This waiver extends to all Southern Belle-affiliated amenities or activities, whether located on-site, off-site, or at any venue under the operation or sponsorship of the Affiliated Entities.
Indemnification
Guest agrees to indemnify, defend, and hold harmless Southern Belle, its owners, employees, agents, affiliates, and the Property homeowner from and against any and all claims, demands, damages, causes of action, losses, or liabilities—including attorney’s fees—arising from:
1. Guest’s or Occupant’s use of or presence on the Property or any Southern Belle or Affiliated Entity facility;
2. Any act, omission, or negligence of Guest or their invitees; or
3. Any breach of this Agreement.
Guest expressly acknowledges that they have the authority to bind all members of their party and visitors to these terms.
Children
Children must be supervised by an adult at all times. Southern Belle and the Property homeowner assume no liability for injuries to children or minors under any circumstances, including at pools, decks, stairs, or recreational areas.
Personal Property
Guest is solely responsible for safeguarding personal property. Southern Belle, the Property homeowner, and any Affiliated Entity are not liable for loss, theft, or damage to personal belongings or vehicles, whether occurring on or off the rental premises.
Compliance with Rules & Conduct
Guest agrees to comply with all posted rules, safety guidelines, and staff instructions regarding the use of the Property, pools, and any affiliated amenities or events. Unsafe behavior, intoxication, or failure to comply with these rules may result in immediate termination of this Agreement, removal from the property or event, and forfeiture of all payments made.
Arbitration and Waiver of Legal Recourse
Any dispute, claim, or controversy arising out of or relating to this Agreement or participation in any Southern Belle or Affiliated Entity activity shall be resolved exclusively by binding arbitration administered by the American Arbitration Association (AAA) in Chatham County, Georgia, under Georgia law. Guest and Southern Belle waive all rights to a trial by jury or participation in any class or representative action.The prevailing party shall be entitled to recover reasonable attorney’s fees and costs.
Governing Law & Severability
This Agreement shall be governed by and construed in accordance with the laws of the State of Georgia. If any portion of this Agreement is held unenforceable, the remaining provisions shall remain in full force and effect.
When Things Break
Southern Belle will make every reasonable effort to ensure all appliances, utilities, and amenities are in proper working condition prior to Guest’s arrival and during their stay. No refunds or rate adjustments will be made for maintenance issues, interruptions, or mechanical failures; however, Southern Belle will respond promptly and in good faith to address and resolve such issues as quickly as possible.
Long-Term Rentals (30+ Days)
Once a reservation meets or exceeds a 30 night stay, it is considered a long-term rental. Similar to a short-term lease, the online amount quoted only covers the base rent. Long-term rental reservations are subject to a security deposit. The security deposit is eligible for a refund based on a post-stay inspection. Any damages outside of normal “wear and tear” will be taken from the security deposit and at Southern Belle Vacation Rentals discretion.
For these reservations, we require an additional cleaning at a cost every 30 days. The cleaning cost varies by property. Please call 912.289.0130 to set up your cleaning schedule.
The first month’s rent and security deposit is required to guarantee your reservation. Each month thereafter, rent plus utilities will be billed within the first 10 days of the month.
Cancellation Policy and Refunds
Short-Term Stays (fewer than 30 nights)
● Cancellations made more than 30 days prior to arrival: 50% refund of the total amount paid.
● Cancellations made within 30 days of arrival: No refund.
● Early departures do not warrant refunds unless Travel Protection has been purchased.
Long-Term Stays (30 nights or more)
● Cancellations made more than 30 days prior to arrival: Guest forfeits 50% of the first month’s rent. The remaining 50% and the reservation deposit will be refunded.
● Cancellations made within 30 days of arrival: Guest forfeits all rent paid, but the reservation deposit will be refunded.
● Early departures do not warrant refunds unless Travel Protection has been purchased.
Payment Schedule:
Short-term reservations require 100% payment at the time of booking.
Long-term reservations require both the reservation deposit and the first month's rent at the time of booking.
You may not transfer your payment to another home in our rental pool should you change your mind and wish to rent a different property than originally agreed upon in your rental agreement.
Vacation Rental Guest Status / No Tenancy (Including Extended or Executive Stays)
Guest acknowledges and agrees that the accommodation provided under this Agreement is a short-term vacation rental and transient lodging, and that Guest is granted only a temporary, revocable license to occupy the property for lodging purposes. Regardless of the length of stay, number of nights reserved, method or frequency of payment, or any designation of the property as an “executive rental,” “extended stay,” or similar term, the parties expressly agree that this Agreement does not create a landlord-tenant relationship, leasehold interest, or residential tenancy, and Guest shall not acquire any rights of possession or tenancy under Georgia landlord-tenant law. Guest understands that the property is offered solely as transient lodging similar to a hotel or vacation rental, and is not intended to serve as Guest’s primary residence. In the event Guest occupies the property for an extended period, including any stay exceeding thirty (30) days or any executive or corporate rental arrangement, Guest’s status remains that of a transient guest and not a tenant, and no tenancy, homestead rights, or other possessory rights shall arise by virtue of the duration of occupancy. Guest expressly agrees that upon expiration or termination of the reservation or Agreement, Guest must immediately vacate the property as required herein and acknowledges that continued occupancy beyond the agreed reservation period shall constitute unauthorized occupancy.
